Terms of Service

1. Parties

These Terms of Service ("Terms") govern the agreement between LingaCast ("LingaCast", "we", "us") and the organisation or individual ("Customer", "you") accessing the LingaCast platform. By creating an account or using the service, you accept these Terms.

2. Service description

LingaCast provides a real-time AI translation and captioning platform for professional live events, including speech-to-text transcription, machine translation, AI dubbing, HLS video delivery, and caption export tools.

3. Accounts and access

• You must provide accurate information when registering an account.
• You are responsible for maintaining the confidentiality of your credentials.
• You must notify us immediately of any unauthorised use of your account.
• Accounts are non-transferable without our written consent.

4. Acceptable use

You agree not to use the service to:

• Process audio or content you do not have the right to transmit or reproduce.
• Infringe any intellectual property, privacy, or broadcasting rights.
• Circumvent technical measures or rate limits.
• Resell or sublicense access to the platform without a written reseller agreement.
• Process content that is unlawful, harassing, defamatory, or harmful.

5. Fees and billing

• Fees are charged monthly in advance based on your selected plan.
• Overage hours are billed at the end of each billing period.
• All prices are exclusive of VAT. Dutch VAT (21%) applies to EU customers without a valid VAT number.
• Invoices are due immediately. Overdue invoices may result in service suspension after 14 days.
• Annual plans are non-refundable except as required by applicable law.

6. Free trial

Your first event is provided free of charge with no credit card required. After the free event, a paid plan is required to continue using the service. LingaCast reserves the right to modify or discontinue the free trial at any time.

7. Service levels

We target 99.5% monthly platform availability, excluding scheduled maintenance. Caption accuracy targets (98.5%) are best-effort and depend on audio quality, speaker clarity, and language availability. Accuracy reports are provided per event on Professional and Enterprise plans.

8. Intellectual property

You retain ownership of all content you submit (audio, transcripts, captions). By using the service, you grant LingaCast a limited licence to process your content solely to provide the service. We do not use your content to train AI models without your explicit consent.

LingaCast retains all rights to the platform, software, and models. Nothing in these Terms transfers any IP rights to you.

9. Confidentiality

Each party agrees to keep the other's confidential information strictly confidential and not to disclose it to third parties without prior written consent. This obligation survives termination for 3 years.

10. Limitation of liability

To the maximum extent permitted by law, LingaCast's total liability for any claim arising under these Terms is limited to the fees paid in the 3 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or data loss.

11. Termination

Either party may terminate with 30 days written notice. We may suspend or terminate immediately for material breach, non-payment, or violation of the acceptable use policy. On termination, your data is retained for 30 days then deleted, unless a longer retention period applies under your plan.

12. Governing law

These Terms are governed by EU law. Any disputes shall be submitted exclusively to the competent courts of the European Union.
